The petitioners/A1 and A3, who were arrested and remanded to judicial custody on 13.03.2025 for the offences punishable under Sections 8(c) r/w.20(b)(ii)(C), 23,25,27A,28 and 29 of NDPS Act in Crime No. 48/01/07/2025 on the file of the respondent police, seek bail.

2. The case of the prosecution is that the petitioners along with other accused were found in illegal possession of 445kgs of ganja. Hence, the case..

3. The learned counsel for the petitioner submits that the respondent police has registered a false case against the petitioners and they have not committed any offence as alleged by the prosecution. He would further submit that the petitioner has been arrested and remanded to judicial custody on 13.03.2025. Hence, he prays to grant bail to the petitioner.

4. The learned Special Public Prosecutor appearing for the respondent would submit that the petitioners along with other accused were found in illegal possession of 445kgs of ganja which is a commercial quantity. Hence, he opposed to grant bail to the petitioners. 2/4

5. This Court heard both sides and perused the materials available on record.

6. Considering the rival submissions on either side and that the contraband involved in this case is commercial quantity and the fact that the petitioners were present in the scene of occurrence at the time of recovery of contraband along with other accused and further petitioners have not satisfied the twin condition as per Section 37 of the NDPS Act hence this Court is not inclined to grant bail to the petitioners.

7. Hence the petition stands dismissed.
