PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.0223 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the first respondent police for the offences punishable under Sections 406, 420, 465, 467, 468 and 34 IPC in Crime No.0223 of 2023 on the file of the second respondent police, seek anticipatory bail. 2.The case of the prosecution is that the defacto complainant was in need of finance assistance in order to expand his business. Hence, he approached the accused persons to arrange loan. The 1/3

accused persons received Rs.3 crores from the defacto complainant as registration fee. Thereafter, they did not respond positively and delayed the loan process. Later, the defacto complainant came to know that the accused persons deceived him in the name of providing loan by creating false documents. Hence, the case. 3.The learned counsel for the petitioners would submit that the petitioners have been falsely implicated in the case and they have nothing to do with the said allegations. He would further submit that Interstate Anticipatory bail may be granted to the petitioners to enable them to move to the appropriate jurisdictional Court in Maharashtra for necessary relief.

4.Taking into consideration the facts and circumstances of the case, this Court is inclined to grant inter-state interim anticipatory bail to the petitioners for a period of six weeks from the date of receipt of a copy of this order to enable them to move to the concerned Court.

5.Accordingly, interim interstate anticipatory bail is granted to the petitioners for a period of six weeks, on condition that the petitioners shall surrender before the learned Judicial Magistrate No.V, Tirunelveli within a period of fifteen days from the date on which the order copy made ready and the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Further, within six weeks from the date of execution of bail bond, the petitioners shall approach the competent Court in Maharashtra and seek appropriate relief. 6.In view of the above directions, this Criminal Original Petition is disposed of.
