Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323, 324, 436, 506(ii) IPC in Crime No.152 of 2018, seeks anticipatory bail. 2.The case of the prosecution is that on 15.07.2018 the defacto complainant's son brought sand from the river in a jute-bag from the purpose of doing repair work of floor of his house, the first accused abused him by saying that he is involving in sand theft. Thereafter, on 16.07.2018 again the first accused abused the defacto complainant and his son. Hence, the complaint. 3.The learned counsel for the petitioner would submit that they have not committed any offence as alleged by the prosecution. 4.Heard the learned counsel for the State.
5.Considering the facts and circumstances of this case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is directed to pay a sum of Rs.15,000/- to the credit of Cr.No.152 of 2018 pending investigation on the file of the respondent police before the learned Judicial Magistrate, Kumbakonam, and on such deposit, the petitioner is ordered to be released on bail in the event of arrest https://hcservices.ecourts.gov.in/hcservices/
or on his appearance before the learned Judicial Magistrate, Kumbakonam, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
