Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, forbidding the first respondent from granting approval to the building built by the second respondent in S.No.9A/3C2, Mudapulikkadu 1 Bit, Peravurani Town Panchayat, Thanjavur District ingressing into petitioner's property (S.No.9A/3C3) without inspecting the same in his presence and to decide in strict compliance with the plan annexed to the compromise decree passed in O.S.No. 35 of 2012 on the file of the Subordinate Judge, Pattukottai, Thanjavur District.

ORDER
The writ petition has been filed for forbidding the first respondent from granting approval to the building built by the second respondent in S.No.9A/3C2, Mudapulikkadu 1 Bit, Peravurani Town Panchayat, Thanjavur District ingressing into petitioner's property (S.No.9A/3C3) without inspecting the same in his presence and to decide in strict compliance with the plan annexed to the compromise decree passed in O.S.No. 35 of 2012 on the file of the Subordinate Judge, Pattukottai, Thanjavur District.
2. This writ petition is disposed of at the time of admission after dispensing notice on the second respondent, who appears to be brother of the petitioner.
3. It appears that there is a pre-existing land dispute them. The petitioner has submitted a representation, dated 03.03.2025 to the first respondent.

4. The learned Special Government Pleader for the first respondent submits that the representation of the petitioner will be considered and disposed of on merits and in accordance with law after giving opportunity to the second respondent.
5. Recording the above submission of the learned Special Government Pleader for the first respondent, the writ petition stands disposed of in terms of the above undertaking on behalf of the first respondent. The first respondent is directed to pass appropriate orders on the representation of the petitioner, dated 03.03.2025 within a period six weeks from today after due notice to the second respondent.
