For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor(Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.30 of 2023 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/Accused who apprehends arrest at the hands of the respondent police for the offences punishable under sections 177,419,468,471 of IPC and Section 24(1) of Cigarette and Other Tobacco Products Act, 2003 of IPC in Crime No. 30 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were found in illegal possession of banned tobacco products and seized 1035 number of Ganesh Tobacco Products, hence the case.

4. The learned counsel for the petitioner would submit that the petitioner has been implicated as an accused based on the confession given by the co-accused. Even according to the case of prosecution A2 obtained passport and went to Dubai and returned to India. A1 is the friend of A2 and they both were arrested and released on bail.

5. The learned Additional Public Prosecutor would submit that the petitioner is the mastermind behind the entire crime. He only fabricated forged signature and created passport for A2.

6. It is seen that A1 and A2 were found in possession of banned tobacco products and they were arrested and remanded to judicial custody. Further the petitioner herein is the master mind behind the entire crime and he only obtained false passport, therefore custodial interrogation of the petitioner is very much required in this case, hence this Court is not inclined to grant anticipatory bail to the petitioner.
