O R D E R

This writ petition has been filed seeking a direction to the first respondent to consider the representation of the petitioner dated 12.08.2017 and conduct enquiry, after affording an opportunity of personal hearing to the petitioner and fourth respondent and cancel the proceedings of the first respondent in Na.Ka.No.5073/A4/2014 dated 19.10.2015 issued in favour of the fourth respondent herein.

2.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader for the respondents 1 and 2.

3.According to the petitioner, the petitioner is running a Nursery Primary School from the year 2003. The fourth respondent, who purchased a school by name Saraswathy Vidhyalaya Matriculation School, which is situated within three kilometres from the petitioner school, changed the name of the school, similar to the name of the petitioner-school, vide the proceedings of the first respondent dated 19.10.2015. Challenging the same, the petitioner is before this Court with the above prayer.

4.Though the writ petition has been filed challenging the impugned orders, the learned counsel for the petitioner, now confines his prayer to direct the first respondent to consider the representation, after affording an opportunity of personal hearing to the petitioner.

5.In view of the said submission, this Court, without going into the merits of the matter, directs the first respondent to consider the representation of the petitioner dated 12.08.2017 and pass orders thereon on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner as well as fourth respondent.

6.With the above direction, this writ petition is disposed of. No costs.
