Mr.M.Sakthi Kumar Government Advocate (Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.92 of 2024 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No.92 of 2024, for the offence punishable under Sections 379 and 506(i) IPC, has filed this petition seeking anticipatory bail.

2. The case of the prosecution is that due to previous enmity, the petitioner had 1/3

taken away the defacto complainant's Car bearing Registration No. TN 31 CD 8910.

3. The learned Counsel appearing for the petitioner submits that the petitioner is a farmer. The defacto complainant has borrowed a sum of Rs.2,00,000/- from the petitioner by mortgaging his car with an assurance that on payment, the defacto complainant would take back the Car. However, he failed to do so.

4. The learned Government Advocate (Crl. Side) appearing for the respondent submits that is the second anticipatory bail application and the petitioner is having 16 previous cases to his credit. Therefore, the earlier anticipatory bail application filed by the petitioner was rejected by this Court by considering the antecedent of the petitioner.

5. Considering the antecedent of the petitioner and as there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
