O R D E R

This petition has been filed seeking to direct the learned Special Judicial Magistrate Special Court for Exclusive Trial of Land Grabbling Cases, Madurai to dispose of the calender case in C.C.No.22 of 2017 in a speedy manner within the time stipulated by this Court.

2. The petitioner is the defacto complainant in Crime No.14 of 2015 for the offence punishable under Sections 120(b), 420, 465, 468, 471, 448, 506(I) of the Indian Penal Code.

3. The learned counsel appearing for the petitioner would submit that after completing the investigation, final report was also filed before the learned Special Judicial Magistrate Special Court for Exclusive Trial of Land Grabbling Cases, Madurai which was also taken on file in C.C.No.22 of 2017. Even after a lapse of five years, there is no progress in this case. Hence, the present petition has been filed.

4. The learned Additional Public Prosecutor would submit that in this case, there are totally three accused. Out of the three accused, A1 and A3 have died. For the purpose of producing the Death Certificate, the case is pending.

But, however, considering the oldness of the matter, there shall be a direction to the learned Special Judicial Magistrate Special Court for Exclusive Trial of Land Grabbling Cases, Madurai to expedite the trial and complete the same within a period of six months from the date of receipt of a copy of this order. The respondent herein is directed to co-operate with the trial Court for completing the trial process.

6. With these directions, this Criminal Original Petition stands allowed.
