/Respondent PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, to call for the records pertaining to the order dated 10.02.2023 made in Crl.R.C.No.79 of 2022 on the file of Learned II Additional District and Sessions Judge, Trichy modifying the order dated 19.07.2022 in Cr.M.P.No. 1949 of 2022 on the file of learned District Munsif cum Judicial Magistrate, Srirangam to return the entire deposited amount to the petitioner.

This criminal original petition has been filed to call for the records pertaining to the order dated 10.02.2023 made in Crl.R.C.No.79 of 2022 on the file of Learned II Additional District and Sessions Judge, Trichy modifying the order dated 19.07.2022 in Cr.M.P.No. 1949 of 2022 on the file of learned District Munsif cum Judicial Magistrate, Srirangam to return the entire deposited amount to the petitioner. 2.Against the order that has been passed by the Revisional Court in Crl.R.C.No.79 of 2022, this petition has been filed. Through the order of revisional Court, it is seen that the original petition that was filed before the trial Court seeking the interim custody of Rs.3,36,000/- is concerned, it was ordered to be deposited in a Nationalised Bank for a period of three years. With the above said direction that petition was dismissed.

Against which, the revision was preferred. Revisional Court on going through the records and on producing the voucher for a portion of the amount namely Rs.2,00,000/-, has modified the above said order by giving direction to return the above said Rs.2,00,000/- to the petitioner after following the proper procedure. The grievance of the petitioner is that in respect of the balance amount also it must be returned earlier. 3.I find no reason to interfere with the above said order.

though the counsel for the petitioner submit that the order of the trial Court may be directed to stand, let the petitioner approach the concerned trial Court and inform about the development. Since it has been stated that remaining amount was not deposited as per its own order, the above said order be complied. The Presiding Officer must take care. 4.With the above said directions, this criminal original petition stands dismissed.
