ORDER : The Court Made the following order :- The petitioner is in judicial custody since 20.08.2018 for the offences punishable under Sections 420, 341, 294(b), 307, 324, 506 (ii) IPC., in Crime No.255 of 2018 on the file of the respondent police. He seeks bail.

2.The case of the prosecution is that there is a dispute between the defacto complainant and the accused with regard to sending the wife of the defacto complainant to Kuwait for the job as a Nurse. In this regard, the accused had also received a sum of Rs.6,50,000/- (Rupees Six Lakhs Fifty Thousand Only) from the defacto complainant. On 19.08.2018 at 06.00 a.m., while the defacto complainant was proceeding near Vettukuzhi Junction, the accused is said to have come in his bike and waylaid the defacto complainant and attacked him with knife on his hand and further, he also scolded with filthy language.

3.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

4.The learned counsel appearing for the petitioner would submit that the petitioner is ready to deposit an amount of Rs.4,00,000/- (Rupees Four Lakhs Only) within a period of six weeks from the date of receipt of a copy of this order.

5.Considering the above facts and circumstances of the case and also considering the undertaking given by the petitioner, this Court is inclined to grant bail to the petitioner on condition that the petitioner shall deposit a sum of Rs.4,00,000/- to the credit of Crime No.255 of 2018 on or before 29.10.2018. Accordingly, the petitioner is ordered to be released on bail subject to the following conditions:

(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate Court No.II, Padmanabhapuram, Kanyakumari District; (ii) the petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders.
