Respondent PRAYER: This Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to issue suitable direction to the learned Judicial Magistrate, Thirumangalam, Madurai for speedy disposal of the case in C.C.No.131 of 2015, on the file of the learned Judicial Magistrate, Thriumangalam, Madurai to dispose the case within the stipulated time prescribed by this Court. O R D E R

This Criminal Original Petition has been filed seeking for a direction to the learned Judicial Magistrate, Thirumangalam, Madurai for speedy disposal of the case in C.C.No.131 of 2015.

2. The learned counsel for the petitioner would submit that the case was registered on 06.04.2015. Thereafter, the final report has been filed in C.C.No.131 of 2015, which is pending before the learned Judicial Magistrate, Thirumangalam. He would submit that the respondents are dragging the case without producing the witnesses. He would further submit that the petitioner as an accused has a right to have speedy trial and would seek for a direction to the learned Magistrate to dispose of the case in C.C.No.131 of 2015, expeditiously within a time frame to be fixed by this Court.

3. The learned Additional Public Prosecutor would submit that the trial has commenced and the case has been posted for examination of L.Ws.3 to 5 on 13.11.2018 and furthermore, three other witnesses have to be examined.

4. In the above circumstances, there will a direction to the learned Judicial Magistrate, Thirumangalam, to complete the trial and dispose the case preferably, within a period of three months from 13.11.2018.

5. With the above observations, the Criminal Original Petition shall stand closed.
