The petitioner/accused, a juvenile in Crime No.96 of 2025 has filed this application that he is prepared to surrender before the 1/4
Juvenile Justice Board, Theni and on his surrender, his bail application has to be considered on the same day.
2.The case of the prosecution is that this petitioner has caused a fatal accident to the father of the second respondent on 04.05.2025 and therefore, a case in Crime No.96 of 2025 has been registered as against him, for the offence under Sections 281 and 106(1) BNS.
3.The learned counsel for the petitioner submits that the petitioner is aged about 17 years. He has completed his higher secondary school and awaiting to join a graduate course. Unfortunately, the accident had happened, due to which, he is not in a position to pursue his further studies.
4.Mr.A.S.Abul Kalaam Azad, learned Government Advocate (Crl side) who takes notice for the first respondent opposes for allowing this petition, as this petitioner has involved in a fatal accident.

5.In view of the above objections and considering the nature of offence, this Court is not inclined to entertain this petition.
