To modify the condition imposed by this Honourable court in Crl.OP(MD).No.11355/2018 dated 05.07.2018.

Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.A.JOHN VINCENT, Advocate for the petitioner and of Mr.CHELLAPANDIAN, Additional Advocate General assisted by Mr.A.ROBINSON, Government Advocate(criminal side) for R1 and Mr.N.NAGENDIRAN, Special Public Prosecutor for CBI Cases for R2, the court made the following order:-

The petitioner was granted bail by this Court in Crl.O.P.(MD) Nos.11355 to 11363 of 2018 subject to certain conditions. One of the conditions was that the petitioner should not enter the District limits of Tuticorin. The petitioner now states that he has to necessarily go to Tuticorin tomorrow in order to attend the Hon'ble Tmt.Justice Aruna Jagadeesan Commission of Inquiry. It has fixed its hearing tomorrow. Therefore, he has filed this petition for relaxation.

2. The learned Government Advocate seeks time, as he wants to get instructions regarding the ground reality.

3. The conditions were imposed by this Court more than an year back. The petitioner only wants to attend the statutory Commission of Inquiry that was appointed by the Government of Tamil Nadu. Therefore, the condition imposed on the petitioner that he should not enter the District limits of Tuticorin stands relaxed so as to enable him to attend the hearings of the Hon'ble Tmt.Justice Aruna Jagadeesan Commission of Inquiry on whatever dates that may be conducted.

4. It is made clear that the relaxation is only to the limited extent of permitting the petitioner to attend the hearings of the Inquiry Commission.

5. This petition is allowed, accordingly.
