Respondents Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus directing the first respondent i.e. the Secretary to Government, Co-operative, Food and Consumer Protection Department, Chennai to pass appropriate orders of the disciplinary case initiated in R.O.C.No.378/A1/2013 (TDP No.4/2013) dated 21.10.2013 of the Commissioner for Disciplinary Proceedings, Madurai on merits and in accordance with law.

ORDER

G.Venseslaus Raja, while serving as Co-operative Sub Registrar/Field Officer, Alanganallur, Madurai District, was facing departmental proceedings. However, on reaching the age of superannuation on 31.05.2016, he was permitted by the Joint Registrar of Co-operative Societies to retire without prejudice to the departmental proceedings already initiated vide proceedings dated 21.10.2013. While so, the Enquiry Officer completed his enquiry and submitted his Report to the Government on 31.07.2015. In regard to the said Report, the petitioner also submitted his https://hcservices.ecourts.gov.in/hcservices/

explanation on 21.03.2016, however, no final order has been passed so far by the competent authority. Hence, the petitioner is before this Court.

Mr.T.R.Janarthanam, learned Additional Government Pleader was put on notice.

Since the Enquiry Officer has already submitted his Report on 31.07.2015 and the petitioner has also submitted his explanation on 21.03.2016, this Court finds no impediment for the first respondent to dispose of the Disciplinary Proceedings dated 21.10.2013, pending against the petitioner. Therefore, the first respondent is directed to pass final orders on the disciplinary proceedings initiated against the petitioner, within a period of eight weeks from the date of receipt of a copy of this order. With the above direction, the writ petition stands disposed of. No costs.
