ORDER

[Order of the Court was made by M.SATHYANARAYANAN, J.] The petitioner was granted financial assistance by the third respondent bank to the tune of Rs.3,50,000/- for manufacture of cement hollow bricks in Survey No.149/12 at Ittamozhi Village, Nanguneri Taluk, Tirunelveli District. given as security for availing the loan. Since the petitioner fails to pay the dues, action was initiated under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. The petitioner, after the receipt of statutory notice, offered a sum of Rs.4,25,000/- to the respondent bank, by way of 'one time settlement'. Since no response was forthcoming, the petitioner came forward to file this Writ Petition.

Today, when the matter is taken-up for consideration, learned Counsel for the petitioner, on instructions, would submit that the amount of Rs.4,25,000/- offered by him towards 'one time settlement' has been accepted by the respondent bank and therefore, nothing survives for adjudication in this Writ Petition.

3. Learned Standing Counsel, appearing on behalf of the respondents, would also endorse the view of the learned Counsel for the petitioner.

In the light of the above, no further orders need be passed in this Writ Petition. No costs. Consequently, this Writ Petition is closed.
