ORDER : This Criminal Original petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.M.VENKATESAN, Advocate for the petitioner and of MR.M.SAKTHI KUMAR, Government Advocate (Crl.Side) on behalf of the 1st Respondent, the Court made the following order:- The learned counsel appearing for the petitioner submits that though the case 1/3

was originally registered by including the offence under Section 380 IPC, the respondent Police has subsequently deleted the offence under Section 380 IPC and now, the offences, on which FIR is pending, are punishable under Sections 109 and 506(i) IPC r/w. Section 3(1) of TNPPDL Act. He further submits that in this case, the private property only got damaged. However, the case has been registered under the TNPPDL Act also. Now, the parties have also amicably settled their issue and therefore, this petition has been moved on the strength of the compromise memo.

2. Mr.M.Sakthi Kumar, learned Government Advocate (Crl. Side) takes notice for the first respondent. Notice to the second respondent returnable in two weeks. Private notice is also permitted.

3. Post the matter after two weeks. In the meantime, the learned Government Advocate (Crl. Side) shall verify the genuineness of the compromise memo and also verify as to whether the compromise memo has been effected without any threat or coercion.
