Prayer: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a writ of Mandamus, directing the respondents to grant permission and necessary protection to perform cultural programme ie., for "Aadal Padal programme" on the eve of Arulmigu Sri Selva Vinayagar, Sri Selva Kaliamman, Sri Selva Bagavathiamman, Sri Selva Karuppanasamy Temple Festival at Karunanithi Nagar, Palani Road, Dindigul District, which is to be held on 24.06.2016.

O R D E R

The writ petition has been filed for issuance of a Writ of Mandamus, directing the respondents to give permission and necessary protection to conduct the Aadal Paadal programme in connection with "Aani festival" in Arulmigu Sri Selva Vinayagar, Sri Selva Kaliamman, Sri Selva Bagavathiamman, Sri Selva Karuppanasamy Temple at Karunanithi Nagar, Palani Road, Dindigul District, scheduled on 24.06.2016.

2.Mr.D.Muruganandam, learned Additional Government Pleader, takes notice for the respondents. By consent, the writ petition is taken up for final disposal at the stage of admission itself. 3.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.

4.The learned counsel appearing for the petitioner would submit that the programme is being conducted by the villagers regularly in order to promote harmony during the above said https://hcservices.ecourts.gov.in/hcservices/

festival period; that a representation was given to the respondents, but, however, the same was not considered by the respondents so far and hence, the petitioner is before this Court with this writ petition. The learned counsel appearing for the petitioner would further submit that as the aforesaid festival is celebrated in a peaceful manner by the villagers, there will be no untoward incident on account of this celebration. 5.The learned Additional Government Pleader appearing for the respondents, on instructions, would submit that during 2013, after grant of permission to conduct the programme, there was untoward incident, in respect of which a First Information Report was registered.

6.In view of the above submission made by the learned Additional Government Pleader, the petitioner is directed to make a fresh representation to the second respondent in person on 23.06.2016 and on receipt of such representation, the second respondent is directed to consider the same and pass appropriate orders on merits and as per law forthwith, as the programme is scheduled to be held on 24.06.2016.

7. With the above direction, the Writ Petition is disposed of. No costs.
