Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to consider the representation of the petitioner, dated 05.12.2017 and promote him to the post of Village Administrative Officer from the post of Village Assistant in the light of G.O.(per) No.570, Revenue Department, dated 26.12.2014 within the stipulated time may be fixed by this Court.

O R D E R

The petitioner seeks to issue a Writ of Mandamus, directing the respondents to consider the representation of the petitioner, dated 05.12.2017 and promote him to the post of Village Administrative Officer from the post of Village Assistant in the light of G.O.(per) No.570, Revenue Department, dated 26.12.2014.

2. Mr.R.Sethuraman, the learned Special Government Pleader takes notice for the respondents.

The learned counsel appearing for the petitioner submitted that it would suffice if the representation of the petitioner dated dated 05.12.2017 is disposed of on merits and in accordance with law, within a time frame to be fixed by this Court. 4.In view of the limited scope of the prayer, without going into the merits of the matter, the second respondent is directed to consider the representation of the petitioner, dated 05.12.2017, in accordance with law, after giving notice to the interested parties, if any, and pass appropriate orders within a period of two months from the date of receipt of a copy of this order, if there are no legal impediments. This Court makes it very clear that if the issue is already settled by any of the proceedings, it is needless for the respondents to answer the issue.

5.With the above direction, the Writ Petition stands disposed of. No costs.
