This Writ Petition has been filed seeking for the issuance of a Writ of Mandamus, directing the respondents to grant permission and protection for "Maveerar Naal" Meeting and rally from Paramakudi Vilakku to Theradi Thidal, Kalaiyarkovil, Sivagangai District on 27.11.2017.
2.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.
3.The learned counsel for the petitioner would submit that the petitioner is the District Organizer for the Sudhanthira Valarchikaana Vivasaya Sangam situated in Sivagangai District. He further stated that the organisation is going to celebrate "Maveerar Naal" on 27.11.2017 at Theradi Thidal, Kalaiyar Kovil, Sivagangai District at about 04.00 p.m. to 10.00 p.m. The petitioner also states that there is a plan to conduct a rally https://hcservices.ecourts.gov.in/hcservices/
from Paramkudi Vilakku to Theradi Thidal before the meeting starts. He further stated that a representation was submitted by the petitioner on 13.11.2017. Though the writ petition has been filed for issuance of a positive direction to the respondents, the learned counsel for the petitioner states that the petitioner will be satisfied, if a direction is issued to the third respondent to consider the petitioner representation dated 13.11.2017 and pass orders within a time stipulated by this Court. 4.Considering the limited scope of the prayer now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the matter is inclined to pass the following order:- The third respondent is directed to consider the representation of the petitioner, dated 13.11.
2017 and pass appropriate orders on merits and in accordance with law on or before 23.11.2017. In case, if any permission and protection is given to the petitioner, the third respondent is at liberty to pass any further orders with regard to any reasonable restrictions and conditions so as to ensure maintenance of law and order and communal harmony.
5. Accordingly, the Writ Petition is disposed of. No costs.
