Prayer: Writ Petition filed under Article 226 of the constitution of India, to issue a writ of Certiorari, to call for the impugned show cause notice dated 28.08.2017 made in Na.Ka.No.662/2017/Case issued by the first respondent to the petitioners and subsequently quash the same as illegal and devoid of merits in respect of the petitioners forthwith.

O R D E R

Heard Mr.S.Palani Velayutham, learned counsel appearing for the petitioner and Mr.R.Velmurugan, learned Government Advocate, who takes notice on behalf of the respondents.

2.The learned counsel for the petitioner seeks permission to withdraw the Writ Petition with liberty to avail the alternative remedy of revision under Section 153 of the Co-operative Societies Act, before the concerned Joint Registrar of Co-operative Societies https://hcservices.ecourts.gov.in/hcservices/

on or before 30.11.2017 against the impugned order dated 28.08.2017 passed by the first respondent.

3.If such revision is filed within the said date, the same shall be dispassionately considered by the concerned Joint Registrar of Co-operative Societies and reasoned orders shall be passed on merits in accordance with law and the decision taken shall be communicated to the petitioner and a report of such compliance shall be filed before the Registrar (Judicial) of this Court on or before 31.03.2018. It is made clear that the impugned order shall not be given effect during the pendency of such revision without the prior permission of the concerned Joint Registrar of Co-operative Societies.

4.Accordingly, this Writ Petition is dismissed as withdrawn with the aforesaid liberty granted to the petitioner. No costs. Consequently, connected miscellaneous petitions are closed. Sd/- Assistant Registrar(AD-II) /True Copy/ Sub Assistant Registrar.
