To set aside the order of the Motor Accident Cliams Tribunal Kulithalai made in M.C.O.P. No. 53/2013, dated 03.01.2020 and allow the appeal with costs.

ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S C.JAWAHAR RAVINDRAN, Advocate for the petitioner, While admitting the CMA., the court made the following order:- There shall be an order of Stay on condition that the petitioner/appellant shall deposit 50 % of the award amount with proportionate interests and costs, awarded in M.C.O.P.No.53 of 2013, on the file of the Motor Accident Claims Tribunal, Kulithalai, https://www.mhc.tn.gov.in/judis 1/2

CMP(MD) No.7758 of 2022 within a period of four weeks from the date of receipt of copy of this order, after deducting the amount already deposited by him, to the credit of M.C.O.P.No.53 of 2013, on the file of the Motor Accident Claims Tribunal, Kulithalai, failing which, stay granted shall stand automatically dismissed.

2. This Petition is allowed accordingly.
