Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents ie., the Deputy Director of Health Services, Dindigul and the Block Medical Officer, Government Primary Health Centre, Uluppakudi, Natham Taluk, Dindigul District to take immediate action to disburse the Encashment of Leave Salary and Special Provident Fund to the petitioner within a specified time frame that may be fixed by this Court.

The petitioner has come forward with the present Writ Petition for issuance of a Writ of Mandamus, directing the respondents ie., the Deputy Director of Health Services, Dindigul and the Block Medical Officer, Government Primary Health Centre, Uluppakudi, Natham Taluk, Dindigul District to take immediate action to disburse the Encashment of Leave Salary and Special Provident Fund to the petitioner within a specified time frame that may be fixed by this Court.

2. Mr.R.Sethuraman, the learned Special Government Pleader

takes Notice for the respondents.

3. When the matter is taken up for hearing, it is represented by the learned Special Government Pleader that the issue on hand is covered by the decision of this Court made in W.P.No.15457 of 2015, which has been confirmed by a Division Bench Judgment of this Court in W.A.No.207 of 2016.

4. In the light of the submission made by the learned Special Government Pleader, this Writ Petition is disposed of with a direction to the Authority concerned, to disburse the Encashment of Leave Salary and Special Provident Fund to the petitioner, if the petitioner is otherwise eligible and if there are no legal impediments. The benefits, if any, shall be given to the petitioner within a period of three months from the date of receipt of a copy of this order. No costs.
