Respondents Writ Petition filed under Article 226 of the Constitution of India for the issuance of a Writ of Certiorarified Mandamus to call for the impugned order dated 16.06.2016 on the file of the 2nd respondent herein, under Na.Ka.No.52/2016/A and to quash the same and direct the 2nd respondent to grant two months time for the purpose of production of all relevant documents under the proceedings initiated under Na.Ka.No.52/2016/A on the file of the 2nd respondent.

ORDER
Mr.V.Ramaraj, serving as Secretary at Gandhi Nagar Cooperative Housing Society, Tirunelveli, was called upon to face the proceedings initiated under Section 81 of the Tamil Nadu Cooperative Societies Act. In the impugned order, it is stated that the petitioner is dragging on the matter without producing the relevant documents to complete the enquiry.

2. However, learned counsel for the petitioner, by submitting that the documents are kept at a new place, where, the Society in question is shifted, seeks three months time to hand over the documents.

Mr.M.Rajarajan, learned Government Advocate, after taking notice, submitted that the petitioner, who is facing the proceedings initiated under Section 81 of the Tamil Nadu Cooperative Societies Act, has to attend the enquiry with all the relevant files. He states that the petitioner cannot be allowed to drag on the matter for some reason or the other.

Since the petitioner seeks time owing to the fact that the Society has been shifted to a new place, this Court, finally, grants six weeks time to the petitioner to produce all the documents before the Enquiry Officer, without fail. In other words, the impugned order of the second respondent, dated 16.06.2016, shall hold good except to state that time alone is extended by six more weeks to the petitioner, enabling him to produce the documents. It is made very clear, no further time will be granted under any circumstance, whatsoever, since the petitioner is facing the proceedings initiated under Section 81 of the Tamil Nadu Co-operative Societies Act. 5.
With the above direction, this Writ Petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
