For Respondent : Mr.KR.Bharathi Kannan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Cr.No.312 of 2020 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 448, 294(b), 353, 392 and 506(ii) IPC, in Crime No.312 of 2020 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner along with other accused persons have trespassed into the TASMAC shop and without paying money, they have stolen the bottles and also made life threat to the defaco complainant. Hence, a case has been registered.

CRL OP(MD). No.12485 of 2020 3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he seeks anticipatory bail.

4.The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the petitioner's earlier petitions for anticipatory bail were dismissed by this Court on 24.08.2020 and 10.09.2020. This is the third petition. He further submitted that the petitioner is a habitual offender and there are 34 previous cases are pending against petitioner in similar in nature. There is no change in circumstance.

5.In view of the above, this Court is not inclined to grant anticipatory bail to the petitioner. This Criminal Original Petition is dismissed accordingly.
