PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents to furnish the informations sought for in the application of the petitioner dated 10.12.2016 under Right to Information Act, 2005 and pass appropriate orders within the time frame fixed by this Honble Court.

O R D E R

This writ petition is filed seeking for mandamus directing the respondents to furnish informations sought for by the petitioner under Right to Information Act, 2005 made through his application dated 10.12.2016.

2. The grievance of the petitioner is that the said request made by the petitioner seeking for information under Right to Information Act, 2005 is not furnished by the first respondent till this date.

3. Needless to state that if information is not furnished within the time stipulated under the Act, the petitioner has to resort to the remedies available under the Act as against such non-furnishing of information. Without doing so, filing of writ petition seeking for mandamus is not proper course of action. Therefore, I find that the present writ petition is totally https://hcservices.ecourts.gov.in/hcservices/

misconceived. Accordingly, this writ petition is dismissed with liberty to agitate the matter in the manner known to law before the appropriate forum as provided under Right to Information Act, 2005. No costs.
