ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 353, 279, 109, 379, 511 IPC r/w Section 21(1) of the Mines and Minerals(Development and Regulation) Act, 1957 in Crime No.139 of 2024 on the file of the respondent police, seeks anticipatory bail. 1/3

2.The case of the prosecution is that the petitioner and other accused have illegally transported sand and when the Police party intercepted them, the accused persons fled away the occurrence place and some of the accused prevented the Police party from performing their duty.

3.The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

4.The learned Government Advocate(Crl.side) for the respondent opposes to grant anticipatory bail to the petitioner on the ground that the petitioner is having five previous case to his credit.

5.Considering the nature of offence and considering that the petitioner is having five previous cases to his credit, this Court is not inclined to grant anticipatory bail to the petitioner.
