COMMON ORDER All these Criminal Original Petitions have been filed seeking to quash the final report filed by the respondent police.
2. It is seen from records that insofar as certain offences are concerned, materials are available in the final report to proceed further in these cases. That apart the C.C.Nos., are of the year 2016. Therefore, it would be appropriate to give a direction to the Court below to complete the proceedings within a reasonable time.
3. Taking into consideration the facts and circumstances of the case, there shall be a direction to the learned Judicial Magistrate, Palani to dispose of the cases in C.C.Nos.199, 203, 204, 205, 207, 222, 223, 224, 225, 226, 227 of 2016, respectively, within a period of three months from the date of receipt of copy of this order.
4. The presence of the petitioners before the trial Court shall be dispensed with, on condition that they shall be present, at the time of questioning under Section 313 of Cr.P.C., and at the time of passing judgment. The learned counsel representing them shall examine the prosecution witnesses on the day they are examined in chief. The petitioners shall not dispute the identity of the witnesses. It is made clear that the petitioners shall be entitled to raise all the grounds that has been raised in these cases before the Court below.
5. With the above directions, these criminal original petitions are disposed of. Consequently, connected miscellaneous petitions are closed.
