Respondents PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the Respondents 1 to 6 to remove the encroachment made by the respondents 7 and 8 to remove the illegally erected cement concrete slab compound wall measuring 6 feet height, iron gate and a tin shed measuring about 100 square feet in the 10 meter wide and 166.726 meter long Thar road which has been left for public use in the northern part of the Acre 0.96 1/2 Cent property shown in Survey No.104/16B, situated at Adhavathur East Village, Srirangam Taluk, Tiruchrappalli District.

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner seeks removal of encroachment alleging that the private respondents have encroached upon the Government land even after the land has been gifted to the local authority. Hence, the petitioner has filed this writ petition.

We find that the petitioner is arrayed as 1st defendant in the suit filed by the private respondents in O.S.No.198 of 2024 on the file of the District Munsif Court, Srirangam, in respect of the same property. The right of the 1st defendant/writ petitioner herein in the said property is also questioned in the said suit. While so, pending the suit, seeking a different prayer by way of writ petition cannot be entertained. The rights of the parties over the property in question shall be decided in the pending suit. Therefore, we do not find any merits in this writ petition.

3. Accordingly, this Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
