Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406, 408, 467, 468, 471, 477(A) r/w 120(b) I.P.C in Crime No.Not Known of 2018, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and other accused persons in this case have misappropriated the amount in the Sakkoor Primary Agricultural Co-operative Credit Society to the tune of Rs.49,53,305/-. Hence, the complaint.

3.Today, when the matter is taken up for hearing the learned Government Advocate (Crl.Side) appearing for the respondent would submit that there is no petition/case is pending against the petitioner.

4.Per contra, the learned counsel for the petitioner would submit that there is a complaint lodged by the Co-operative Deputy Registrar, Sivagangai and the same was forwarded to the respondent police. Hence, he vehemently opposed the submission made by the learned Government Advocate(Crl.Side).

https://hcservices.ecourts.gov.in/hcservices/ 5.At this juncture, without going into the merits of complaint and the allegation levelled as against the petitioner, this Court

is inclined to grant anticipatory bail to the petitioner. 6.Whenever the case has been registered as against the petitioner, other than this complaint, the respondent is directed to deal with the same in accordance with law.

7.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, No.II, Sivagangai and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall report before the respondent police daily twice i.e morning at 10.30 am and evening at 5.30 p.m until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.

8.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
