ORDER

The present Writ Petition has been filed for issuance of a Writ of Certiorari to quash the impugned order passed by the 2nd respondent in Na.Ka.No. 343/Aa2/2020 dated 31.10.2020 as confirmed by the impugned order passed by the 1st Respondent in Na.Ka.No.459/U/2021 dated 24.04.2024.

2. The present impugned order was passed under Section 77A of the Registration Act. The respondents are not having right or jurisdiction to entertain any claim under Section 77A of the Registration Act, as it has been held to be ultra vires.

3. Accordingly, this writ petition is allowed. The impugned proceedings are hereby quashed. Since the civil suit in O.S. No. 398 of 2021 is pending on the file of the Principal District Munsif Court, Tenkasi, the parties are at liberty to 2/4

approach the competent civil court to agitate their rights. There shall be no order as to costs.
