Appeal filed under section 14-A(2) of Schedule Case and Schedule Tribes (Prevention Atrocities ) Amendment Act, 2015, to call for the records relating to the order in Cr.M.P.No.86 of 2025 before the Special Court for exclusive trial of cases under SC/ST (POA) Act, Sivagangai, dated 19.03.2025. ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.R.Senthil Kumar, Advocate for the Petitioner and of Mr.A.Albert James, Government Advocate (Crl.side ) for the 1st and 2nd Respondents, this Court made the following order:
This petition is filed to relax the condition which was imposed on the petitioner in Crl.A.(MD)No.417 of 2025 dated 09.04.2025.
2. The learned Additional Public Prosecutor submitted that the petitioner has been complying with the condition for 45 days, without any default.
3. Considering the fact that the petitioner is complying the condition regularly and also taking into consideration of the family situation cited by the petitioner in the affidavit filed in support of this petition, I feel that the condition imposed on the petitioner can be modified to a certain extent.
4. Accordingly, the condition already imposed is modified as to the petitioner shall stay at Coimbatore and report before the Inspector of Police, Peelamedu Police Station on the 1st day of every English Calender month (if is a holiday, then he shall sign the next day) at 10.30 a.m., till the disposal of the appeal.
