The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 35 days in filing the appeal against the award, dated 17.12.2024 made in M.C.O.P.No.135 of 2022 on the file of the Motor Accident Claims Tribunal ( Special District Judge No.II), Tiruchirappalli.

2. The learned counsel for the petitioner would submit that since the fourth respondent had remained ex-parte, notice may be dispensed with and filed a memo to that effect. He would further submit that execution proceeding is pending.

3. The said memo is recorded. Heard the learned counsel for the petitioner as well as the learned counsel for R1 to R3 and the learned Government Advocate (Civil Side) for R5 and R6 and also perused the records.

4. Considering the reasons assigned and also taking note of the quantum of delay, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to take the appeal on file, if it is otherwise in order and list the matter on 15.06.2026.
