ORDER
This Civil Revision Petition is filed to set aside the fair and decreetal order passed in E.P.No.47 of 2014 in L.A.O.P.No.91 of 1987 dated 02.07.2019 on the file of the Principal Subordinate Court, Tenkasi, allow the Civil Revision Petition.
2. A report was called for from the learned Principal Subordinate Judge, Tenkasi, as to the stage of the execution proceedings. The report is received stating that ex parte order was passed in E.P.No.47 of 2014. To set aside the ex parte order E.A.No.6 of 2024 is filed by the revision petitioner and it is posted for filing counter.
3. In view of the above submission, the petitioner is directed to work out remedy in the E.A. Petition itself. There shall be a direction to the learned Principal Subordinate Judge, Tenkasi, to dispose of the E.A.No.6 of 2024 within a period of one month from the date of receipt of a copy of this order. Depending upon the outcome of the E.A. petition, further proceedings can be taken by the parties, if so aggrieved. 3/5
4. With the above said direction and liberty, this Civil Revision Petition is disposed of. No costs. Consequently, connected miscellaneous petition stands closed.
