Respondents Writ Petition filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus directing the respondents to revise the salary of the petitioner from the date when it was due in pursuant to the G.O.No.395 Finance(Salary Section) Department dated 14.10.2010 and consequentially revise the pension accordingly and to pay the arrears amount due to the petitioner.

ORDER

Mrs.Saraswathy, attained the age of superannuation on 31.08.2010, after serving as Nursing Superintendent Grade I, in the Government Medical College, Tuticorin District. https://hcservices.ecourts.gov.in/hcservices/

The grievance of the petitioner is that the salary for the post of Staff Nurse and Nursing Superintendent was revised with effect from 01.01.2006 and the monetary benefit with effect from 01.10.2010 through G.O.Ms.No.395 Finance (Salary Section) Department dated 14.10.2010. As per the said Government Order, the petitioner is entitled to get benefit. Therefore, she made various representations to the respondents right from 2012. Since the said representations have not been considered by the respondents, she has filed the present Writ Petition.

3. Mr.R.Anandharaj, learned Government Advocate was put on notice.

4. In view of the limited prayer sought for in this Writ Petition, the second respondent is directed to consider the representation of the petitioner, dated 29.04.2016, on merits and in accordance with law, in tune with the Government Order made in G.O.Ms.No.395 Finance (Salary Section) Department dated 14.10.2010 and pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. No costs.
