Petition filed under Article 226 of the Constitution of India, praying for the issuance of a writ of Mandamus to direct the 3rd respondent to issue the patta to the petitioner with regard to the lands in Thadikombu Village S.No.2352 an extent of 91 cents that was situated at Thadikombu Village, Dindigul Taluk, Dindigul District.

O R D E R

The petitioner seeks for grant of UDR patta. To that effect, the petitioner has already approached the third respondent/Tashildar, who in turn referred the matter to the second respondent.

2.It appears that the competent authority to decide the claim of the petitioner is fourth respondent, namely, District Revenue Officer. Therefore, the second respondent has to send the report to the fourth respondent and in turn the fourth respondent has to consider the claim of the petitioner and pass orders on merits and in accordance with law.

3.This Court, at this stage, has not expressed any view on the claim made by the petitioner, as it is for the fourth respondent to consider and decide, after hearing the petitioner as well as rival claimants, if any.

4.Therefore, this writ petition is disposed of by directing the second respondent to send the report to the fourth respondent within a period of four weeks from the date of receipt of a copy of this order. On receipt of the report from the second respondent, the fourth respondent shall pass appropriate orders on the same on merits and in accordance with law, within a period of twelve weeks thereafter. No costs.
