For petitioner : Mr.Rajaraman R For R1 to R3 : Mr.B.Nambiselvan Additional Public Prosecutor O RDER This Criminal Original Petition has been filed seeking to direct the 3rd and 4th respondents not to harass the petitioner on the guise of enquiry on the basis of the complaint preferred by the 5th respondent vide complaint receipt in CSR No.277 of 2023.
2. The learned counsel for the petitioner would submit that over the share of ancestral property, the suit in O.S.No.1 of 2011 was filed by the fifth respondent, that was also dismissed on 27.01.2015 by the learned IV Additional District Judge, Madurai, against which, appeal has been preferred. In the mean time, the petitioner gave a complaint, as if the harassment was made by the fourth respondent with help of third respondent herein to deliver the property to the fifth respondent.
3. The learned Additional Public Prosecutor would submit that the complaint and the counter complaints were given by both side parties. During the course of enquiry, both sides appeared and gave a statement that they will workout their remedy through appropriate civil process. On 2/4
the basis of the above said undertaken, the above said complaint have been closed.
4. Recording the submission made by the learned Additional Public Prosecutor and since both complaints have been closed, nothing survives for further consideration or direction in this matter.
