ORDER : The Court made the following order :- The petitioner / Accused, who was arrested and remanded to judicial custody on 08.01.2026, for the offences punishable under Sections 8(c) r/w. 20(b)(ii)(A), 22(C), 25, 29(1) of NDPS Act, in Crime No.4 of 2026 on the file 1/4

of the respondent police, seeks bail.

2. The case of the prosecution is that on 08.01.2026 at 05.30 p.m., on secret information, the respondent police went to the scene of occurrence and they found that the accused persons are in joint possession of 58 grams of Methamphatamine and 20 grams of ganja oil. Hence, the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. The respondent police without conducting any proper enquiry registered this false case. Hence, he prayed bail for the petitioner.

4. The learned Government Advocate (crl. Side) appearing for the respondent would submit that the offence are grave in nature. The quantity involved in this case is commercial quantity. The petitioner has no previous case. The recovery was made only from this petitioner. Investigation has also been filed and charge sheet has also been filed. Hence, he opposed the grant of bail to the petitioner.

5. This Court heard both sides and perused the materials available on record.

Considering the rival submissions made by the learned counsel on either side, considering the nature of charges levelled against the petitioner, the quantity involved in this case is commercial quantity, though investigation has been completed and charge sheet has also been filed, considering the gravity of offences, this Court is declined to grant bail to the petitioner, at this stage. 7.Accordingly, this criminal original petition stands dismissed.
