Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus directing the second respondent herein to consider the petitioner's representations, dated 21.03.2015 and 06.06.2016 and to reinstate the petitioner as Driver in the third respondent Corporation within a stipulated time fixed by this Court. ORDER

The petitioner Mr.S.Sekar, who was appointed as Driver in the second respondent Transport Corporation, suffered a registration of F.I.R in Crime No. 269 of 2010 by the Kanyakumari Police, for the offence punishable under Sections 294(b), 324 and 332 of I.P.C and for which, he was suspended by the second respondent on 09.06.2010. Pursuant thereto, a charge memo was also issued. The same was questioned by the petitioner in W.P(MD)No. 9615 of 2010. Subsequently, the said Writ Petition was dismissed. Later on, the criminal case registered against the petitioner was taken https://hcservices.ecourts.gov.in/hcservices/

up for final hearing by the learned Judicial Magistrate No.I, Nagercoil in C.C.No.258 of 2010 and the learned Magistrate acquitted the petitioner from all the charges. Therefore, the petitioner has made a representation on 06.06.2016 requesting the respondents to reinstate him in service. Since the same has not been considered so far, the petitioner has come forward with the present Writ Petition.

2. Mr.K.Sathiyasingh, the learned standing counsel, who took notice on behalf of the respondents submitted that the representation of the petitioner would be considered within two weeks.

3. In view of the above, considering the limited scope of the prayer made by the petitioner, this Courts directs the second respondent to consider the representation of the petitioner, dated 06.06.2016, and dispose of the same, on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. No Costs.
