When it was pointed out to the learned counsel appearing for the petitioner that Writ Petition against the second respondent which is a co-operative society would not lie in view of the decision of the Full Bench of Five Judges this Court in K.Marappan Vs. The Deputy Registrar of Co-operative Societies, Namakkal Circle, Namakkal - 636 001 and another [2006(4) CTC 689], the learned counsel for the petitioner sought permission of this Court to withdraw the writ petition and submitted that it would suffice if the first respondent considers and passes orders on the representation dated 18.09.2017 made by the petitioner. entitlement of the claim made, directs the first respondent to dispassionately consider the petitioner's representation dated 18.09.2017 and pass reasoned orders on merits and in accordance with law and communicate the decision taken to the petitioner on or before 15.12.2017.

2.Accordingly, this Writ Petition is dismissed as withdrawn with the above observations. No costs.
