PRAYER :- For Bail in Cr.No.164/2022 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/Accused herein, who was arrested on 31.05.2022 for the alleged offence under Sections 279, 337, 304(2) IPC, in Crime No.164 of 2022, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that on 30.05.2022, the defacto complainant along with others returning to home after finishing their work. At about 06.30PM, the defacto complainant along with his wife, mother and one Anitha were walking left side of the road, at that time, the accused drove the vehicle bearing registration No.TN 67 P 1773, in the same direction and dashed against them, in which, two were died and one person sustained injuries. Hence, the case.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

CRL OP(MD). No.12743 of 2022 4.The learned Additional Public Prosecutor submitted that as per medical examination report of the petitioner it is found that though he consumed liquor, he was not under the influence of alcohol. In this case, major portion of investigation has been completed by the prosecution.
5.Considering the period of incarceration, the fact that the petitioner is not having any bad antecedent and considering the stage of investigation, this Court is inclined to grant bail to the petitioner with stringent conditions.
6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned District Munsif cum Judicial Magistrate, Aathoor, Dindigul District, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
