ORDER : The Court Made the following order :- The petitioner is in judicial custody since 13.08.2018 for the offences punishable under Sections 294(b), 323, 506(i) @ 304 (ii) IPC, in Crime No.488 of 2018 on the file of the respondent police. He seeks bail.
2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent. 3.The case of the prosecution is that on 11.08.2018, the deceased Mathayan, who is said to have come from Housur and trespassed into the house of the petitioner with an intention to commit theft. But originally, the above said Mathayan, was in drunken mood, wrongly entered into the petitioner's house. On wrong identification, the neighbors of the petitioner were gathered and caught hold the deceased and he was assaulted by the gatherings and handed over to the respondent Police.
4.The learned counsel for the petitioner would submit that the petitioner is in incarceration from 13.08.2018 onwards. Hence, he prays for bail.
5.Considering the above facts and circumstances and also considering the period of incarceration of the petitioner, this Court is inclined to grant bail to the petitioner. Accordingly, the https://hcservices.ecourts.gov.in/hcservices/
petitioner is ordered to be released on bail subject to the following conditions:
(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.III, Dindigul.
