PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., to expedite the investigation and to file the final report in Crime No.14 of 2016 on the file of the respondent police, within time frame as specified by this Court.

ORDER

This petition has been filed seeking direction to the respondent to file a final report in Crime No.14 of 2016 pending on the file of the respondent police.

2. The grievance of the petitioner is that based on the complaint given by the petitioner, a case in Crime No.14 of 2016 has been registered for the offences under Sections 498(A), 406 IPC on the file of the respondent police on 21.11.2016. But so far, no investigation is conducted on the said complaint. Hence, the petitioner has come before this Court with the present petition.

3. Heard the learned counsel on either side and perused the materials placed on record.

4. Today, when the matter is taken up for hearing, the learned Government Advocate (Crl.Side) appearing for the respondent, on instructions, would submit that the investigation in the complaint lodged by the petitioner has been completed and final report has https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.9950 of 2019 also been filed before the learned Judicial Magistrate, Eranial and the same is yet to be taken on file.

5. Since the investigation in the complaint lodged by the petitioner has been completed and final report has also been filed before the concerned Magistrate, the relief as such sought for by the petitioner in the present petition cannot be granted. Accordingly, this Criminal Original Petition is dismissed.
