This Writ Petition has been filed for issuing direction to the 2nd 1/4
respondent police to provide police protection to the life and limb and property of the petitioner by considering the representation, dated 24.01.2023.
2. The learned counsel appearing for the petitioner submitted that over the property issue, this petitioner and others filed a suit in O.S.No. 33 of 2009 and that was also partly decreed in their favour and the same was confirmed on appeal in A.S.No.380 of 2017. Against which Second Appeal was preferred by the counter parties and the same is pending. Pending Second Appeal, the private respondents trespassed into the property of the petitioner by making construction, over which, the petitioner has given a present representation.

The learned Additional Public Prosecutor would submit that during the course of enquiry, both sides appeared and the private respondents given an undertaking that they will not make any construction or trouble to the petitioner and they will abide the Court order passed in the civil suits. On the basis of the above said undertaking given by the private respondents, the above said complaint was closed on 20.02.2023.

4. In view of the above said submission, nothing survives for adjudication in this writ Petition. However, if any trouble arise in future the petitioner may give a fresh representation to the 2nd respondent.
5. With the above direction, this Writ Petition is disposed of as infructuous. No costs.
