PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents to survey the land in Survey No.303/1 situated at Otttudanpatti, Kuppanapuram Post, Kadambur, Kayathar Taluk, Tuticorin and consequently, to direct the respondents to grant patta in petitioner's favor after conducing survey and fixing the boundaries by considering his representation, dated 21.07.2021 and 27.07.2021 respectively within period that may be stipulated by this Court. This writ petition is filed for issuance of a writ of Mandamus, to direct the respondents to survey the land in Survey No.303/1 situated at Otttudanpatti, Kuppanapuram Post, Kadambur, Kayathar Taluk, Tuticorin and consequently, to direct the respondents to grant patta in petitioner's favor after conducing survey and fixing the boundaries by considering his representation, dated 21.07.2021 and 27.07.2021 respectively within period that may be 2/5
stipulated by this Court.
2.The petitioner is claiming rights over the property based on the sale deed, dated 28.04.1988. The respondents shall issue notice to the petitioner, if there is any rival claim, the respondents shall notice to the rival claimants as well. After conducting the enquiry, the respondents shall survey the property and issue patta to the petitioner.
3.With the above said observation, the writ petition is disposed of. No costs.
