THE HON'BLE MR.JUSTICE K.MURALI SHANKAR N.B.Anbumani ... Petitioner Vs.

1.The Superintendent of Police, Tiruchirappalli District, Tiruchirappalli.

2.The Inspector of Police, Vaiyampatti Police Station, Tiruchirappalli District.

3.Raju 4.Perumayi ... Respondents PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the second respondent to provide police protection to the life and limb of the petitioner from the respondents 3 and 4.

For Petitioner : Mr.R.Murugappan 1/4

For Respondents : Mr.B.Nambiselvan, Additional Public Prosecutor

ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders, to direct the second respondent to provide police protection to the life and limb of the petitioner from the respondents 3 and 4.

2. The learned counsel for the petitioner would submit that the petitioner has given a representation to the second respondent seeking police protection on the ground that the private respondents had been threatening to sell his land and they have also followed him whenever he visited his land.

3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the State. 2/4

4. As rightly pointed out by the learned Government Advocate (Criminal Side), the petitioner has been attempting to get police protection to his property, under the guise of getting protection to the life and limb of the petitioner. Admittedly, there is no enforceable decree or order from the jurisdictional civil Court and as such, granting of police protection does not arise at all. As of now, leaving open the petitioner's rights and remedies, this Criminal Original Petition is dismissed. 16.06.2023 NCC : Yes/No Index : Yes / No Internet : Yes / No das To 1.The Superintendent of Police, Tiruchirappalli District, Tiruchirappalli.
