For Respondent : Mr.P.Kottai Chamy , Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 21 of 2022 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 11 of Child Marriage Prohibition Act, 2006, in Crime No.21 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. Heard the learned counsel for the petitioners and the learned Government Advocate(Crl.Side) appearing for the respondent. 3.The case of the prosecution is that the defacto complainant is a Social Welfare Officer who stated in complaint that child marriage is going to performed between the victim girl and A-1. On secret information she went and made enquiry. Based on a complaint given by the aforesaid officer the present complaint has been registered.

4.The learned counsel appearing for the petitioners submitted that the victim girl was secured by the police and now she is undergoing school education.

CRL OP(MD). No.12732 of 2022 5.Considering the facts and circumstances of the case and the nature of allegation levelled against this petitioners, this Court is inclined to grant bail to the petitioners, however, with stringent conditions.

6.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or their appearance, before the learned Judicial Magistrate No.VI, Madurai, and on their executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only)each, with two sureties, each for a like sum to the satisfaction of the learned Magistrate concerned; and the petitioner shall appear before the respondent police on every Saturday at 10.30 am until further orders. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

7.The petitioners shall appear before the concerned Magistrate within a period of fifteen days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
