ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The patta issued to the private persons are sought to be quashed in the present Writ proceedings.

2.Admittedly, the civil suit is pending between the parties. That apart, other proceedings are also pending before the revenue authorities. Patta has been granted by the Tahsildar concerned. Therefore, the appeal would lie before the Revenue Divisional Officer concerned under the provisions of Tamil Nadu Patta Passbook Act, 1983. Regarding the title, the parties have to approach the civil Court to establish their rights. For cancellation of patta, the petitioner has to approach the appellate authority under the provisions of the Patta Passbook Act. However, the disputed facts relating to civil rights cannot be adjudicated in a Writ proceedings.

3.The learned counsel appearing for the petitioner would draw the attention of this Court with reference to the documents, which require an adjudication of enquiry from the hands of the competent authority. 4.With the above observation, this Writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
