Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for the issuance of Writ of Certiorarified Mandamus calling for the records relating to the impugned order dated 12.06.2016 on the file of the 3rd Respondent and quash the same as illegal and consequently direct the 1st Respondent to grant permission for conducting demonstration on 26.06.2016 or any other date at the State Bank of India Ground, Theni, Theni District from morning 10.00 am to 12.00 p.m. For Petitioner :

O R D E R

The writ petition has been filed, seeking to quash the impugned order dated 12.06.2016 passed by the 3rd Respondent herein, in which, the request for conducting demonstration at the State Bank of India Ground, Theni, Theni District, was rejected. The petitioner also sought a consequential direction to the 3rd respondent to grant permission for the same.

2. Mr.D.Muruganandam, learned Additional Government Pleader, takes notice for the respondents. By consent, the writ petition itself is taken up for final disposal.

3. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents, who would submit that the date suggested by the petitioner for conducting demonstration already got expired and in the event of the petitioner making a fresh representation to the 3rd respondent, the same will be considered and suitable orders will be passed thereon.

4. Under such circumstances, the petitioner is directed to submit a fresh representation to the 3rd respondent police on 13.07.2016 by specifying any date within 15 days from the date of representation, viz., 13.07.2016. The 3rd respondent in turn is directed to consider the representation to be made by the petitioner and pass orders thereon on merits and in accordance with law within a period of one week from the date of receipt of representation.
