Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari calling for the records relating to the impugned charge memo-cum-suspension order passed by the first respondent in Ref.No.1/D4/638/Sattam/ThaAPoKa/Ee.Ma/2018, dated 28.6.2018 and to quash the same as illegal.

ORDER

The Petitioner has come forward with this Writ Petition seeking to issue a Writ of Certiorari to quash the impugned charge memo-cumsuspension order passed by the first respondent in Ref.No.1/D4/638/Sattam/ThaAPoKa/Ee.Ma/2018, dated 28.6.2018. 2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.When the matter is taken up for hearing today, the learned counsel for the Petitioner submitted that the suspension order has been revoked by order, dated 28.8.2018.It has been stated in the https://hcservices.ecourts.gov.in/hcservices/

said order that the Petitioner has given a reply. According to the Petitioner, he has not given any reply. Since the impugned order of suspension is revoked, it is needless to mention that it is open to the Petitioner to submit reply and the documents that are going to be relied upon by the respondents may also be furnished to the Petitioner.

4.Accordingly, the respondents are directed to furnish the documents to be relied upon by them to the petitioner within a period of two weeks from the date of receipt of a copy of this order. On such receipt of documents, the Petitioner is directed to submit his reply within a period of two weeks thereafter. If the Petitioner fails to submit his explanation within the time referred to above, the authorities concerned shall proceed with the departmental proceedings in accordance with law. 5.With the above directions, the Writ Petition is closed.
