ORDER
This writ petition has been filed, seeking a writ of mandamus directing the 2nd respondent to effect sub-division of 00.15.00 Ares out of 00.23.00 ares in S.No.254/2A2E and an extent of 00.45.00 Ares out of 00.61.00 in Survey No.254/2A23 and also to effect mutation of patta for the above properties of Panangulam Village, Alangudi Taluk, Pudukottai District.
2.Heard both sides.
3.By consent, the writ petition is taken up for final disposal at the stage of admission itself.
4.The learned counsel for the petitioner would submit that there is neither civil suit nor rival claim what so ever is pending in respect of the properties in question. The above said properties were decreed in his favour, as his share, in O.S.No.22 of 2013 by the civil Court. Hence, the petitioner sent representations to the https://hcservices.ecourts.gov.in/hcservices/
respondents, for mutation of patta in his favour. Since, the claim of the petitioner, was not fully met with by the respondents, the petitioner is before this Court.
5.The learned Special Government Pleader appearing for the respondents, on instructions, submitted that the representation of the petitioner would be considered on merits within the time stipulated by this Court.
6.Considering the limited scope of the relief sought in this writ petition, this Court, without going into the merits of the case, directs the second respondent to consider the representation of the petitioner dated 27.10.2017 and pass appropriate orders, on merits and in accordance with law, after affording due opportunity of hearing to the petitioner as well as all the interested parties, if any, within a period of six weeks from the date of receipt of a copy of this order.
